Certain of our Affiliates (for example, El Towne Financial Services, Inc.) may present distinct legal notices on their respective websites. In such instances, that Affiliate’s legal notices shall govern for that specific Affiliate.

These Legal Notices delineate information and policies concerning this Website, our Mobile Applications, Social Media Platforms, and electronic mail communications we may dispatch to you, as well as other interactions we may have with you. As utilized herein, the terms “user,” “you,” and “your” denote individuals who engage with El Towne. Capitalized terms are defined within our Privacy Policy.

Attribution

Energy Efficiency and Savings

All energy efficiency assessments and claims are generated by independent energy rating entities. El Towne offers no warranty or guarantee regarding energy efficiency or the monthly or annual utility expenditures for a residence, nor does it warrant that a home as occupied will achieve the savings or efficiency levels identified by such entities. Energy efficiency and costs will fluctuate from month to month and may vary substantially due to numerous factors, encompassing, but not limited to, the number of occupants residing in the home, energy conservation habits, utility rates and associated fees, the home’s orientation relative to cardinal directions, home maintenance practices, appliance usage patterns, options and upgrades installed by El Towne and other modifications to the residence, preferred indoor temperature settings, and prevailing weather conditions. El Towne retains the right to alter or modify features or components without prior notification or obligation.

ENERGY STAR®

ENERGY STAR and the ENERGY STAR mark are registered trademarks owned by the U.S. Environmental Protection Agency (“EPA”). The EPA initiated the ENERGY STAR program in 1992 as a voluntary, government-backed labeling initiative to furnish organizations and consumers with information concerning cost-effective, energy-efficient products, practices, and services. The ENERGY STAR program was extended to encompass new homes in 1995. El Towne is an active participant in the ENERGY STAR program.  

While not universally available across all communities, residences that attain ENERGY STAR certification adhere to stringent energy efficiency criteria established by the EPA, as verified by an independent energy rating company. El Towne does not represent that all residences sold by El Towne are ENERGY STAR certified homes.

Fair Housing

El Towne acknowledges the paramount importance and significance of fair housing principles. Our business operations are conducted in strict compliance with all applicable federal, state, and local fair housing laws. Our established policy is to provide equitable professional service to all individuals without regard to race, color, religion, sex, disability, familial status, or national origin. Visual representations of models do not indicate any preference for homebuyers based on these protected characteristics.

Homes and Communities

Residences are subject to prior sale or lease. Information pertaining to homes and communities, association fees (if applicable), included features, terms, availability, and amenities is subject to alteration at any time without prior notice or obligation. Drawings, pictorial representations, photographs, videos, square footage measurements, floor plans, elevations, features, colors, and dimensions are provided for illustrative purposes only and may differ from the constructed residences. Landscaping and furnishings depicted may be decorator items not included in the purchase price and may not be available for purchase.

Home Energy Rating System (HERS)®

The HERS Index is a registered trademark of the Residential Energy Services Network (“RESNET”), a 501(c)(3) non-profit organization established in 1995 to develop and maintain national standards for assessing building energy and resource energy performance. While not offered in every community, if provided, the HERS (“Home Energy Rating System”) Index enables prospective buyers to compare the relative energy efficiency of different homes. The HERS Index home energy rating is determined by an independent RESNET-certified home energy rater (“Rater”). A lower HERS Index score signifies greater energy efficiency relative to the HERS reference home. For each unit decrease in the HERS Index score, there is a corresponding one percent (1%) reduction in energy consumption compared to a home with a HERS Index of 100. Utilizing RESNET’s energy efficiency software, the Rater calculates a home’s energy rating by analyzing the home’s construction blueprints and conducting on-site inspections; the HERS rating provided by El Towne is not an “as-built” rating.  

The HERS Index score for a residence, and any estimated energy costs displayed on its label, are estimations only and are based upon the average energy performance for specified home categories as determined by HERS. El Towne offers no warranty or guarantee that a home as constructed or as occupied will achieve the stated HERS Index score or that the amount of energy costs shown, if displayed on its label, is accurate or will be realized. El Towne does not represent that all residences sold by El Towne have undergone individual rating assessments. Furthermore, an energy rating score may or may not account for all options and/or upgrades available for installation in a home. As a home and its associated equipment age, the HERS rating for that home will change, as a home’s energy efficiency typically diminishes over time. The estimated monthly energy costs, if displayed on a label, were derived by dividing the estimated annual energy costs (as determined by the Rater) by twelve months. It is important to note that more recent energy-efficient building codes have been adopted in certain states, consequently, newly constructed homes in those states will generally achieve a HERS Index score below 100 and thus may exhibit greater energy efficiency than the HERS-referenced “standard new home.”

Incentives and Promotions

Incentives and seller contributions are subject to specific terms and conditions and may necessitate the utilization of particular lenders or title companies, some of which may be Affiliates of El Towne. The use of an Affiliate is not a prerequisite for purchasing a home. Incentives and seller contributions may influence your loan amount. Promotional offers are typically restricted to designated homes and communities for a finite period and are subject to modification without prior notice.

Plans

The availability of specific house plans will be restricted to particular lots and phases within a community.

Prices

Pricing for “Available Homes” refers to the specific purchase price of that identified residence. Pricing indicated as “From” or “Starting in the” denotes the approximate base price of the house plan and does not encompass optional features or premiums, unless explicitly stated otherwise. Pricing excludes closing costs and other fees payable by the homebuyer. While El Towne endeavors to present accurate pricing information on this website, no representations or warranties are made in this regard. Prices are subject to change without prior notification.  

Refund Policy

Prior to the closing of a sale, your entitlement to a refund of your earnest money deposit or any option deposit will be governed by the provisions outlined in your real estate purchase contract. Typically, your real estate purchase contract will stipulate that deposits are refundable only if a contingency specifically enumerated within your real estate purchase contract is not satisfied or in the event of a seller default. Subsequent to closing, no refunds will be provided. For any repair or warranty inquiries concerning your home, please contact us.

Schools

No representations or warranties are made regarding school districts or school assignments; it is incumbent upon you to conduct your own due diligence concerning current and future schools and school attendance boundaries.

Views

No representation or warranties are made that the view from a property will remain unaltered; future development, the growth of landscaping, and similar factors may impact views currently enjoyed from the property.

Zero Energy Ready Home (ZERH)

The DOE Zero Energy Ready Home name and the DOE Zero Energy Ready Home mark are owned by the U.S. Department of Energy (DOE). The DOE initiated the ZERH program in 2012 as a voluntary program to identify builders who adhere to DOE’s stringent guidelines for energy performance. El Towne intends to be an active participant in the DOE ZERH program.. While not available in every community, residences that achieve ZERH certification will be verified by a qualified independent energy rating company to meet mandatory ENERGY STAR requirements from the EPA and strict construction requirements from the DOE. A ZERH certified home does not guarantee the achievement of zero net energy performance. El Towne does not represent that all residences sold by El Towne are ZERH certified homes.
